Soho private members' club has initiated legal action against a retail giant, Next, alleging copyright and design right infringements related to home interior products.
The dispute arose when the private members' club identified furniture items promoted and sold by the retailer that 'closely resembled' the club's own furniture line. According to legal documents, the club became aware in February of the retailer's marketing and selling of products purportedly mirroring the club's popular designs.
The club's interior design brand, launched in 2016, replicates the aesthetic seen in its members-only spaces. The legal claim highlights specific items, including a marble coffee table described as one of the club's 'best-selling' products.
The filing also points to promotional materials from the retailer that allegedly featured a book with the club's logo on its spine. Additionally, the legal documents reference a social media post from February, which discussed the retailer's 'dupes', including a side table said to be similar to the club's designs.
Legal representation for the club is led by Nick Buckland of Lewis Silkin, while the retailer has engaged Open Plan Law. The club is seeking a court declaration that the retailer infringed on its copyright and design rights, along with an injunction, costs, and an inquiry into damages.
In response, a spokesperson for the retailer stated that they are 'aware of the situation' and have been in correspondence with the club's solicitors, adding that they 'will defend vigorously' in court.
